Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CheckMate A380 application (the "App") provided by Seneca Labs ("we," "our," or "us"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years of age to create an account and use the App. By using the App you represent that you meet this age requirement.

2. Account Registration

To access the App's features you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

3. Description of the App

The App is a study tool designed to help pilots prepare for A380 type rating assessments. It provides flashcard-based review of technical knowledge, limitations, procedures, and systems content.

4. Disclaimer — Not an Official Training Resource

The content in this App has been compiled from publicly available aviation information, personal training experience, and contributions from experienced line pilots and instructors. It does not reproduce or contain proprietary material from any operator, manufacturer, or authority. No content in the App should be treated as authoritative operational guidance.

Content may contain errors, omissions, or become outdated. You must always cross-reference information with the current, approved documentation provided by your operator and relevant authority. Seneca Labs accepts no responsibility whatsoever for operational decisions, training outcomes, or any other consequences arising from use of the App.

By using the App you acknowledge and agree that: (a) the App is for personal study guidance only; (b) it is your sole responsibility to verify all information against official, current sources; (c) the App has no official standing in any training or checking environment; and (d) Seneca Labs bears no liability for inaccuracies in content.

5. Intellectual Property

5.1 Our Content

All questions, answers, study content, graphics, design, and software in the App are the intellectual property of Seneca Labs or its licensors and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

5.2 Your Content

You retain ownership of any custom flashcards, notes, or annotations you create within the App. By creating content in the App you grant us a limited, non-exclusive licence to store, display, and transmit that content solely for the purpose of providing the App's services to you.

5.3 Content Sources and Third-Party Material

The App's study content has been independently developed from publicly available aviation knowledge, the personal training experience of its creators, and contributions from experienced line pilots and type-rated instructors. The App does not reproduce, copy, or contain proprietary content from any aircraft manufacturer, airline operator, training organisation, or civil aviation authority. Where the App references concepts that relate to aircraft manuals or regulatory publications, such references are for study context only and do not constitute reproduction of those materials.

6. Subscriptions and Payments

6.1 In-App Purchases

Certain features of the App may require a paid subscription, processed through Apple's In-App Purchase mechanism. Payment is charged to your Apple ID account at confirmation of purchase.

6.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID account settings.

6.3 Refunds

Refund requests are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly.

7. Acceptable Use

You agree not to:

• Share your account credentials with others or allow multiple people to use a single account
• Reverse-engineer, decompile, or disassemble the App or its content
• Scrape, extract, or systematically download App content
• Use the App for any commercial purpose other than your personal study
• Upload, submit, or share content that is harmful, offensive, or unlawful, or that contains confidential, proprietary, or copyrighted material belonging to any airline operator, aircraft manufacturer, training organisation, or authority (including manuals, procedures, company notices, or training/checking materials)
• Attempt to circumvent any security or access control measures

7.1 Community Submissions, Review & Zero-Tolerance Policy

The App allows you to submit study content (such as scenario summaries, gameplans, or notes) for possible inclusion in the App's community area. Submissions are not published automatically. Every submission is placed in a private review queue and is not visible to other users unless and until we select, edit, and publish it as featured content at our sole discretion. Content shown to other users is curated and, where featured, edited or authored by us.

You are solely responsible for any content you submit, and you represent and warrant that: (a) it is your own original work and you hold all necessary rights to it; (b) it does not contain, reproduce, or derive from any confidential, proprietary, or copyrighted material of any third party — including any airline's or operator's Operations Manuals, FCOM, FCTM, QRH, standard operating procedures, company notices, or training and checking materials, or any manufacturer's technical documentation; and (c) you are not restricted from disclosing it by any employer, contract, confidentiality obligation, or law.

By submitting content you grant Seneca Labs a worldwide, non-exclusive, royalty-free, sublicensable licence to review, store, reproduce, adapt, edit, translate, publish, display, distribute, and otherwise use that content — including in modified or derivative form and as featured content shown anonymously — for the purpose of operating, moderating, and improving the App. You retain ownership of your original content.

We operate a zero-tolerance policy for objectionable content and abusive behaviour. You can report content shown in the App. We review reports and may remove content, decline or withdraw featuring, and suspend or terminate accounts that violate these Terms, at our discretion and without notice.

You agree to indemnify and hold harmless Seneca Labs and its owners from any claim, demand, loss, or liability (including reasonable legal fees) arising out of content you submit or your breach of these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENECA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR ERRORS IN CONTENT.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR CURRENT.

10. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time through the App's settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, as applicable in the Emirate of Ajman where Seneca Labs is registered. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

13. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Seneca Labs, not Apple. Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
